REQUEST to the UN and the Paris Peace Accords of 1973 signatories to reconvene the international conference on Vietnam so as to give justice to the citizens of the Republic of Vietnam (South Vietnam)

-     Mr. Ban Ki-Moon, Secretary General of the United Nations

-     The Governments of the United States of America, France, United Kingdom, Russia, Canada, Hungary, Poland and Indonesia.  

We, undersigned, citizens of the Republic of Vietnam, actually living in Vietnam and/or in exile in the world as well as those who care for Vietnam, have the honour of submitting the present demand to Mr. Secretary General of the United Nations and the governments which signed the Paris Peace Accord in 1973, exception made of the People’s Republic of China and the Democratic Republic of Vietnam (Socialist Republic of Vietnam).   

-     Considering that on the 30th of April, 1975, the Democratic Republic of Vietnam invaded the Republic of Vietnam (South Vietnam) by force, in violation of the Paris Peace Accord it signed on the 27th of January, 1973 as well as the Final Act of the International Conference on Vietnam by which signatories guaranteed the right to territorial integrity of Vietnam and the right to self-determination of the people of the Republic of Vietnam by the tenure of free elections under international supervision (provisions 9 and 15 of the Peace Accord). 

-     Considering that following this illegal invasion in contravention with the Charter of the United Nations, the Democratic Republic of Vietnam (Socialist Republic of Vietnam) persecuted, imprisoned and assassinated thousands of citizens of the Republic of Vietnam, therefore constituting a war crime, a genocide and a crime against humanity totally contrary to international conventions and to the principles defended by the International Criminal Court.  The Republic of Vietnam has been, before the illegal invasion of 1975, an official observer before the United Nations.   

-     Considering that since the illegal invasion until today, the Socialist Republic of Vietnam, the invading authority, has imposed inhuman treatments and politics over the population of the Republic of Vietnam, such as sending massive amounts of population into forced labour to clear the land for cultivation into savage zones and rename them into New Economic Zones, while the property of the people is seized and they are collectively and systematically mistreated, thus reducing the life of war survivors, widows and families to misery.    

-     Considering that during the past 35 years, the Socialist Republic of Vietnam constantly used and applied political measures of repression by violence, torture, imprisonment and systematic executions of citizens of the Republic of Vietnam, religious dissidents and political dissidents, therefore causing the exile of the citizens of the Republic of Vietnam, during which thousands lost their lives, all this added up with the export of cheap labour and women, citizens of the Republic of Vietnam, by the Socialist Republic of Vietnam, and much more inhuman and degrading treatments.   

-     Considering that the Spratleys and Paracels islands have always been a property of the Republic of Vietnam by the Geneva Conventions and that the Final Act of the Conference on Vietnam, signed in March 1973, guarantees the territorial integrity of Vietnam (provisions 2 and 4), the illegal invasion of the said islands by the People’s Republic of China in 1973 and in 1988 constitutes an obvious violation of the said international treaties.   

-     Considering that the Republic of Vietnam is represented by a de jure government following the principle of State continuity. 

Consequently, we, undersigned, citizens of the Republic of Vietnam, respectuously request Mr. Secretary General and the signatory governments of the Final Act of the International Conference on Vietnam, in the name of justice, equity, honour, primacy of law and in respect of promises, to : 

1-      Request the countries who violated or are still violating the integrity of Vietnam to stop such violations

2-      Request the signatories of the Final Act of the International Conference on Vietnam to reunite following provision 7 b) of the said act so as to decide of the “necessary remedial measure”

3-      Request the Socialist Republic of Vietnam to respect the right to self-determination of the citizens of the Republic of Vietnam by organising and/or not intervening in free elections held under international supervision according to provisions 9 and 15 of the Paris Peace Accords and provisions 2 and 4 of the Final Act of the International Conference on Vietnam.

4-      In a spirit of reconciliation and pacifism, the Republic of Vietnam would accept that all of Vietnam be submitted to a temporary mandate of the United Nations for a duration of two years prior to free elections so as to ensure that the people will chose a political party in respect of provisions 9 and 15 of the Paris Peace Accords and provisions 2 and 4 of the Final Act of the International Conference on Vietnam.

5-      On the contrary, whereas the Socialist Republic of Vietnam, formerly Democratic Republic of Vietnam, and the People’s Republic of China would not respect their signature on the treaties, thus discrediting the rest of the signatories, we, the citizens of the Republic of Vietnam still living in Vietnam and/or exiled outside Vietnam request from the signatories and member of the United Nations and free countries of the world to wilfully support us in our fight to emancipate from the illegal invaders.
